Terms of Service

1. Introduction and Parties

These Terms of Service ("Terms") constitute a binding agreement between you ("you" or "User") and The Dell Ltd, a company registered in Malta (Company Registration Number C109946), with registered office at The Fort, Level 3, HardRock Business Park, Triq Burmarrad, Naxxar, NXR 6345, Malta ("we", "us", "the Company"), governing your access to and use of the GoCV.ai platform (the "Service").

By creating an account or otherwise using the Service, you confirm that you have read, understood and accepted these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 16 years old to use GoCV.ai. By registering you represent and warrant that (i) you meet this age requirement, (ii) you have legal capacity to enter into a contract under the law applicable to you, and (iii) the information you provide is true, accurate and complete.

3. Description of the Service

GoCV.ai is an AI-assisted career platform that provides:

• CV Lab: creation, editing, ATS analysis, AI tailoring and PDF export of CVs/resumes.
• Job Discovery: aggregation of publicly available job listings across the AI, Tech, Gaming/iGaming, Crypto and Remote sectors.
• Job Match & Apply Pack: AI fit analysis between your profile and a job description, with one-click generation of tailored CV + cover letter + interview prep.
• Application Tracker: Kanban / list pipeline to manage applications, follow-ups and statuses.
• Cover Letter Generator: AI-generated, role-tailored cover letters in multiple formats and tones.
• Interview Prep: role-specific questions, STAR answer building, company research, salary intelligence.
• LinkedIn Optimizer: AI suggestions for headline, About, experience bullets and keywords.
• Career Profile & Career Library: persistent repository of achievements, projects, skills and STAR stories used to feed AI features.
• Insights: personal analytics on profile completeness and application performance.

The Service is a tool to assist your job search. We are not an employment agency, recruitment agency or temporary work agency within the meaning of EU Directive 2008/104/EC or Italian D.Lgs. 276/2003. We do not act as an intermediary between candidates and employers and do not select or place candidates.

4. Account Registration and Security

• You must register with a valid email address and verify it before gaining full access.
• You are responsible for keeping your credentials confidential and for all activities that occur under your account.
• You must notify us immediately at security@gocv.ai if you suspect unauthorised access.
• We may suspend or disable accounts that violate these Terms or pose a security risk.
• One natural person may hold one account; account sharing is not permitted.

5. Free and Paid Plans

GoCV.ai offers a free tier with limited functionality and paid subscription plans ("Pro") with extended access. Plan features and prices are displayed on the pricing page and may evolve over time.

• Free plan: limited CV analyses, limited job matches, limited cover letters, basic application tracking, preview of interview prep.
• Pro plan: unlimited CV tailoring and ATS optimisation, unlimited job matching and Apply Packs, full application tracker, unlimited cover letters and recruiter messages, full interview prep and mock coaching, LinkedIn optimization and weekly action plans.

6. Payments, Billing and Cancellation

• Pro subscriptions are billed in advance on a recurring basis (monthly, quarterly, semi-annually or annually) according to the plan you select.
• All prices are in Euro (€) and inclusive of VAT where applicable. The applicable VAT rate is determined according to your billing country in line with EU Directive 2006/112/EC.
• Payments are processed by Stripe Payments Europe Ltd.; by subscribing you also agree to Stripe's terms (stripe.com/legal/consumer).
• You may cancel at any time from your account settings or by contacting support. Cancellation takes effect at the end of the current billing period; access to Pro features continues until that date.
• Except where required by mandatory law, fees already paid are non-refundable for partial periods or unused features.
• If we offer a free trial, you may cancel before its end without charge; otherwise the subscription will renew automatically at the standard price.
• We may change prices with at least 30 days' prior notice by email; the new price applies from the next renewal. You may cancel before the change takes effect.
• Failure to collect payment may lead to suspension or termination of the Pro plan.

7. Right of Withdrawal (EU Consumers) and Express Waiver

If you are a consumer resident in the European Union, you ordinarily have the right to withdraw from a distance contract within 14 days under Directive 2011/83/EU (in Italy: Codice del Consumo, D.Lgs. 206/2005, articles 52 ff.).

Express waiver — digital content/services delivered immediately. By purchasing a Pro subscription you (i) expressly request that the Service starts during the 14-day withdrawal period, (ii) acknowledge that the Service is provided as digital content not on a tangible medium / digital service, and (iii) expressly consent to lose your right of withdrawal once the supply has begun (Directive 2011/83/EU art. 16(m); Codice del Consumo art. 59(o)). The checkout flow includes a confirmation step recording your express consent.

If, exceptionally, you have not yet started using any Pro feature and you are within 14 days of purchase, you may request withdrawal by writing to billing@gocv.ai from your account email. The model withdrawal form (Annex I(B) of Directive 2011/83/EU) is available upon request.

8. Conformity and Statutory Guarantees

For consumers, we provide the Service in accordance with the contract pursuant to Directive (EU) 2019/770 on digital content and services (in Italy: D.Lgs. 173/2021 amending the Codice del Consumo). You may report a lack of conformity within the limitation periods set by your national law by writing to support@gocv.ai and we will endeavour to bring the Service into conformity at no cost. Statutory consumer rights are not limited by these Terms.

9. Intellectual Property

• Your content: you retain all rights to the content you upload and create on GoCV.ai (CVs, cover letters, career data). You grant us a worldwide, royalty-free, non-exclusive, limited licence to host, store, process, transmit and display your content solely for the purpose of operating and providing the Service to you.
• Our content: the GoCV.ai platform — including software code, design, templates, branding, trademarks and AI prompts/orchestration — is owned by The Dell Ltd or its licensors and is protected by intellectual property laws. You may not copy, modify, translate, distribute, reverse-engineer, decompile or create derivative works of any part of the Service except as expressly permitted by law.
• AI-generated output: output produced by the AI features is provided to you for your personal and professional use. You own the final material you produce; however, due to the nature of generative AI, identical or similar output may be generated for other users and we do not warrant exclusivity.

9-bis. Job Listings, Aggregation and Takedown

GoCV.ai aggregates publicly available job listings from third-party careers pages in the AI/ML, Gaming/iGaming, Crypto/Blockchain and Remote niches. Aggregation is performed solely for the purpose of allowing users to discover relevant opportunities and is carried out in accordance with Article 4 of Directive (EU) 2019/790 (text and data mining of lawfully accessible content) and Article 15 of Regulation (EU) 2016/679 (legitimate interest in providing a discovery service).

• We do not claim ownership of third-party job descriptions, brands or trademarks. All rights remain with the original employer or rights holder.
• Listings are stored only for the time necessary to provide the discovery feature and are refreshed every 2 days. Outdated or filled positions are removed automatically.
• We respect robots.txt, noindex directives and explicit opt-out signals from source websites. We do not bypass technical access restrictions or paywalls.
• Rights holders, employers or affected third parties may at any time request the removal of a specific listing using our takedown form or by writing to legal@gocv.ai. We commit to reviewing and processing valid takedown requests within 5 business days.
• Users acknowledge that AI-generated analyses (job-fit reports, cover letters, etc.) produced from these listings are personal-use derivative works and must not be redistributed.

10. Acceptable Use

You agree not to:

• Use the Service in violation of any applicable law (including export controls, employment law and anti-discrimination law).
• Upload false, misleading or fraudulent information in your CV, profile or applications.
• Upload personal data of third parties without a valid legal basis.
• Attempt to gain unauthorised access to other users' accounts, data or our infrastructure.
• Use bots, scrapers or automated tools to access or extract data from the Service.
• Resell, redistribute, white-label or commercially exploit the Service or its output without our prior written consent.
• Upload content that infringes third-party rights or that contains malware.
• Use the Service to generate or apply for jobs in a manner intended to defraud employers or recruitment platforms.
• Use the AI features to generate illegal, harmful, discriminatory, deceptive or otherwise prohibited content under applicable law (including the EU AI Act, Regulation 2024/1689).

We reserve the right to investigate suspected violations and to suspend or terminate accounts in breach of these Terms.

11. AI Disclaimer

AI-generated output is provided "as is" on a probabilistic basis and may contain inaccuracies, omissions or recommendations that are not appropriate for your specific situation. You are solely responsible for reviewing, editing and validating any AI-generated content (including CVs, cover letters, ATS scores, fit analyses, interview questions and salary estimates) before using it in any professional context.

GoCV.ai does not guarantee any specific career outcome — including but not limited to job offers, interview invitations, salary increases or higher response rates. Any statistics, averages or benchmarks displayed in the Service are illustrative and based on aggregate or third-party data.

12. Job Listings Disclaimer

Job listings displayed in the Service are aggregated from publicly available sources or company career pages. We do not warrant the accuracy, currency, availability or legitimacy of any listing and we are not responsible for the recruitment processes, contractual terms or conduct of any third-party employer. Always verify a listing directly with the employer before sharing personal information or sending money.

13. Service Availability and Modifications

The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, secure or free of harmful components. We may modify, suspend or discontinue any part of the Service at any time, providing reasonable prior notice for material changes that affect paying users. If we discontinue a paid feature you have already paid for, we will refund the unused pro-rata portion of your subscription.

14. Limitation of Liability

To the maximum extent permitted by applicable law:

• We exclude all implied warranties not expressly granted in these Terms.
• We shall not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, business opportunities, data or goodwill, even if advised of the possibility of such damages.
• Our aggregate liability towards you for all claims arising from or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) one hundred euros (€100).

Nothing in this section limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, fraud or wilful misconduct, or mandatory consumer protection warranties.

15. Indemnification

To the extent permitted by law (and excluding consumer claims that may not be waived under mandatory law), you agree to indemnify and hold harmless The Dell Ltd, its directors, employees and agents from any third-party claim arising out of (i) content you upload, (ii) your breach of these Terms, or (iii) your violation of any third-party right or applicable law.

16. Termination

• You may delete your account at any time from settings or by writing to support@gocv.ai. Personal data will be erased as described in the Privacy Policy.
• We may suspend or terminate your account with reasonable notice, or immediately for serious breach of these Terms, fraudulent activity, security risk or as required by law.
• Sections that by their nature should survive termination (IP, liability, indemnity, governing law) shall survive.

17. Personal Data

Personal data is processed in accordance with our Privacy Policy, which forms an integral part of these Terms.

18. Force Majeure

We shall not be liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including acts of God, war, terrorism, strikes, pandemics, internet outages, third-party infrastructure failures, governmental orders or regulatory actions.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of Malta, excluding its conflict-of- laws rules. The courts of Malta shall have exclusive jurisdiction over any dispute arising from or in connection with these Terms.

Consumers. If you are a consumer habitually resident in the European Union, nothing in this section deprives you of the protection afforded by mandatory provisions of the law of your country of residence (Regulation (EC) 593/2008 — Rome I — art. 6) and you may also bring proceedings before the courts of your place of residence (Regulation (EU) 1215/2012 — Brussels I bis — art. 18). Italian consumers retain the exclusive competence of the court of their place of residence or domicile under Codice del Consumo art. 33(2)(u).

20. Dispute Resolution (Consumers)

Following the European Commission's decision to discontinue the Online Dispute Resolution (ODR) platform on 20 July 2025 (Regulation (EU) 2024/3228 repealing Reg. (EU) 524/2013), EU consumers may contact us directly at support@gocv.ai to seek an amicable resolution before initiating any formal proceedings. We are not currently bound to use a specific Alternative Dispute Resolution body. Nothing in this section limits your right to bring proceedings before the competent court of your place of residence under Regulation (EU) 1215/2012 (Brussels I bis), art. 18.

21. Severability and Assignment

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. We may assign these Terms in connection with a merger, acquisition or sale of assets; you may not assign your rights without our prior written consent.

22. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified by email and/or in-product notice at least 15 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms; if you do not agree, you may cancel your subscription before the effective date.
